Terms of Service

These Terms of Service ("Terms") govern your use of Thought Free, a personal thought capture and organization application available at thoughtfree.io, operated by WholenessMedia ("we", "us", or "our").

By creating an account or using Thought Free, you agree to be bound by these Terms. If you do not agree, please do not use the service.

1. Eligibility

You must be at least 16 years old to use Thought Free, in compliance with the GDPR minimum age for data processing consent. By using the service, you represent that you meet this requirement.

2. Your Account

You sign in to Thought Free using Google OAuth. You are responsible for:

  • Maintaining the security of your Google account
  • All activity that occurs under your Thought Free account
  • Notifying us promptly if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use Thought Free to:

  • Store or transmit content that is illegal, harmful, threatening, abusive, or harassing
  • Infringe on the intellectual property rights of others
  • Attempt to gain unauthorized access to our systems or other users' data
  • Interfere with or disrupt the service or its infrastructure
  • Use the API in ways that exceed rate limits or abuse system resources
  • Reverse-engineer, decompile, or disassemble any part of the service
  • Use the service for automated scraping, data mining, or training AI models

4. Your Content

You own your content. All thoughts, diary entries, notes, and other content you create in Thought Free remain your intellectual property. We do not claim ownership over any content you submit.

By using the service, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the service (including AI processing features you explicitly initiate). This license terminates when you delete your content or your account.

You can export your data at any time using the built-in export feature (JSON, Markdown, or Obsidian vault format).

5. AI-Generated Content

Thought Free uses artificial intelligence for features such as auto-classification, research summaries, action item extraction, and content analysis. Please be aware that:

  • AI-generated content is provided as-is and may contain errors or inaccuracies
  • AI outputs should not be relied upon as professional, medical, legal, or financial advice
  • You are responsible for reviewing and verifying any AI-generated content before acting on it
  • AI processing is performed by third-party providers (see our Privacy Policy for details)

6. Subscription Plans & Billing

Thought Free offers a free tier and optional paid subscription plans (Pro, Team). If you subscribe to a paid plan:

  • Payment processing is handled by RevenueCat (via Stripe for web, Google Play for Android). By subscribing, you also agree to the applicable payment processor's terms of service.
  • Billing cycle — Subscriptions are billed monthly or annually, depending on the plan you choose. Charges are recurring until you cancel.
  • Cancellation — You can cancel your subscription at any time through the Customer Portal. Access continues until the end of your current billing period.
  • Refunds — We handle refund requests on a case-by-case basis. Contact us at support@thoughtfree.io.
  • Price changes — We may change pricing with 30 days' advance notice. Existing subscriptions are honored until the end of the current billing period.

7. API Usage

Thought Free provides a public API for external integrations. API access is subject to:

  • Rate limits based on your subscription tier (free: 60 req/min, pro: 300 req/min)
  • A maximum of 5 active API keys per account
  • The same acceptable use policies that apply to the web application

You are responsible for keeping your API keys secure. We may revoke API keys that are used in violation of these Terms.

8. Service Availability

We strive to keep Thought Free available and reliable, but we do not guarantee uninterrupted or error-free operation. The service is provided on an "as available" basis.

We may temporarily suspend the service for maintenance, updates, or security reasons. We will make reasonable efforts to provide advance notice of planned downtime.

Thought Free includes offline capabilities — your data is stored locally on your device and remains accessible even when the service is unavailable.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Thought Free is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
  • Our total liability for any claims related to the service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.
  • We are not responsible for data loss. While we implement reasonable security measures and provide data export tools, you are responsible for maintaining your own backups.

Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Intellectual Property

The Thought Free application, including its design, code, logos, and documentation, is the intellectual property of WholenessMedia. You may not copy, modify, distribute, or create derivative works based on our application without our written permission.

This does not apply to your content — as stated in Section 4, you retain full ownership of everything you create in Thought Free.

11. Termination

By you: You can stop using Thought Free at any time. To delete your account and all associated data, contact us at support@thoughtfree.io. Before deletion, we recommend exporting your data using the built-in export feature.

By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if we discontinue the service. If we discontinue the service, we will provide at least 30 days' notice and ensure you can export your data.

Upon termination, your right to use the service ceases. Data deletion will be performed in accordance with our Privacy Policy.

12. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Lithuania and applicable European Union regulations, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of Thought Free shall be subject to the exclusive jurisdiction of the courts of the Republic of Lithuania, unless EU consumer protection law grants you the right to bring proceedings in your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via an in-app notification or email at least 30 days before the changes take effect. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
